a child together. what they used was his sperm and donated eggs. then close became pregnant with twins through in vitro fertilization. after twins were born in july, he revealed to her he was gay, told her you're just a surrogate and demanded custody of the children. now, keep in mind they're his biological children even though she carried them. and now a houston judge has ruled she is indeed the mother by law of the twins not just a temperatu surrogate. this is a pretty fascinating case. i mean, how did the judge make the ruling that she's the mother when she's not the biological mother? >> well, she is not the biological mother, but she did give birth to these children. and texas law may have been on her side here because the law is fairly explicit when it comes to issues. the intended parents of the child or children have to be married. there was no marriage in this case. also a surrogacy agreement approved ahead of time. there was no legal agreement between the two. so when the children were born, she gave birth to them and she had every bit of standing according to the court to be

gravidarum, is because they're expecting twins. if that is the case, how would that affect the succession? is it literally the first one out is the heir? >> like you say, if this legislation comes into play, which i suspect it will ahead of the birth, then yes, if the firstborn, the first twin to birth is a girl, then she will take precedence over either the sister or the brother. >> how's the betting going on a name? i'm hearing piers is in the frame. are you hearing that? >> i haven't heard piers. i've heard people say if it's a girl, surely there's got to be diana in there somewhere. the interesting thing with royal babies is they always have many more names than you or i. most of us have one, possibly two. i think prince william has something like five or six. ancestors do have to be taken into the equation when it comes to naming but i think speculation on that will probably be a little bit further down the line. i think there's also a feeling over here of people just wanting to be -- err on the side of caution. people want to celebrate, people are talking about this very good news b
